These Terms of Service (the “Terms”) govern your use of the Astrology Magic mobile application and related services (the “Service”) operated by American Global Nexus LLC (“we”, “us”, “our”). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Astrology Magic generates Vedic astrological charts based on birth date, time, and place that you provide. Charts are computed using the Swiss Ephemeris.
2. Entertainment, Not Professional Advice
Astrology Magic is provided for entertainment and self-reflection only. Charts and any interpretive content are not professional advice and are not a substitute for medical, legal, financial, psychological, or any other professional advice. You should not make any significant life decision based solely on output from the Service. If you need professional advice, consult a qualified professional.
3. Eligibility
The Service is not directed to children under 13 (or under 16 in the EU/UK). By using the Service you confirm you are at least the minimum age in your jurisdiction. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
4. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law
- Use the Service to generate excessive or automated requests that disrupt operation
- Use the Service to violate any law or the rights of any third party
- Misrepresent that output of the Service is professional advice
5. Your Content
The birth details you enter remain your own. As described in the Privacy Policy, those details are stored on your device. By using the Service you grant us a limited, transient license to process those details for the sole purpose of computing your chart and returning it to you.
6. Intellectual Property
The Astrology Magic name, logo, app design, and our software are the property of American Global Nexus LLC or our licensors and are protected by intellectual-property laws. The Swiss Ephemeris is licensed from Astrodienst AG. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.
7. Third-Party Services
City lookups are powered by the OpenStreetMap Nominatim service, subject to its usage policy and the OpenStreetMap copyright.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE FOR ANY PARTICULAR USE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICAN GLOBAL NEXUS LLC AND ITS OFFICERS, MEMBERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) USD $10.
10. Indemnification
You agree to defend, indemnify, and hold harmless American Global Nexus LLC and its officers, members, and agents from any claim or demand arising from your violation of these Terms or your use of the Service in violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by uninstalling the App.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be brought in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the effective date at the top of this page and, where appropriate, surface the change in the App. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
